Mr.. Fernandez:

Let me take this opportunity to clear up a number of misconceptions that seem to be fueling the fire of requests for the prosecution of Dallas Crown.

First, in order to prosecute any person or entity for a criminal offense, someone makes a complaint to a law enforcement agency or a crime is committed in the presence of a law enforcement officer. That agency then investigates the complaint, makes a report and submits it to this office. We then review the report and either ask for additional information or file an information (for misdemeanors) or present an indictment to the grand jury (for felonies).  

No offenses relating to horse slaughtering have been the subject of a complaint made to a local law enforcement agency in Kaufman County .  

Second, the slaughtering of horses is not illegal. The alleged offense which sparked this controversy arose over the sale of horse meat for human consumption, in violation of Chapter 149 of the Texas Agricultural Code, not the actual killing of horses.  

Third, a federal judge has specifically ruled that Chapter 149 of the Texas Agricultural Code "is preempted by federal law and/or has been repealed."  

Personally, I do not like the idea of killing horses. Some of the greatest moments in my life occurred on the back of a horse. There was one period of time that I went almost two years without missing a day being on a horse. In my mind, horses are among the most intelligent and caring animals on earth. Dogs are man's best friend by a slim margin, at best. Whenever I get really depressed, I watch "The Man From Snowy River" for the "umpteenth time." There are few days that go by that I do not listen to the soundtrack from that movie. I am listening to it at this moment. If you have not seen the movie, you should not let the day pass without renting it. If you love horses, you will feel like you are seventeen, again.

My last horse, "Jabo," was given to a lady for her grandchildren to ride. She initially offered to buy Jabo, and offered a handsome price, but I refused to sell him to her. I told her that she could have him, but only on the promise that she would take care of him until he died. He was 21 at the time and is no longer with us. That was in 1974 and I still remember that no horse in Freestone County ever outran us and no horse ever beat us to a cow that decided she didn't want to go where we wanted her to.

However, until the legislature makes horse slaughtering illegal, there is nothing to be done. While I understand that this is an emotionally charged issue, you should understand that the issue is not whether or not horses will be slaughtered but whether, after they are killed, they will be used for dog food or sold for human consumption overseas.

Dear Mr. Walton:

As a concerned horse lover, I am writing you in order to request  that you PROSECUTE DALLAS CROWN PACKING INC., the slaughter facility  located at in Kaufman County , (2000 West Fair Kaufman), Texas , for their  ILLEGAL OPERATION and for their CRIMINAL ACTIVITIES AS PER TEXAS  AGRICULTURAL CODE 149 AND 148. These chapters of the Texas Agriculture  Code make it illegal to sell, offer to sale, or transfer horsemeat for  human consumption WHEREEVER IT TAKES PLACE, and, therefore make it  ILLEGAL the activities of the two only slaughterhouses remaining in the   United States . It is without saying that I am absolutely opposed to the  criminal activities of that facilities  

Horses are not mere animals. Horses are a symbol of freedom for  many Americans and, for many people –like me- , they are like people  but in the ‘right way’ (there are only good and kind horses, despite  their condition, not ‘evil horses’, the only ‘evil’ here is the human  being and it´s overwhelmingly cruel behaviour toward these lovely  creatures, who haven´t got hurt anybody or anything). Please, think in  all the things that horses have done for humans and specially for the   United States : They have worked in farms improving agricultural  production when there were not tractors or combinated harvesters, they have been used as a transport -specially by those who conquered the  United States-, they have worked in mines and they have been forced to  take part in the most ‘dirty business’ of the human being like wars,  terrible things that a horse will never do. Think that if you have your  job, it is because you are a ‘Representative of Justice’, (Justice who says that you MUST PROSECUTE that facility) and that has been possible  because millions of horses died to pull your country into the ‘developed  world’; and how do humans pay them?, by an horrible and fateful fate,  proper of a nightmare, by killing them to satisfy the most evil and  cruel feelings of a bunch of hateful and hardhearted snobs (foreign, by  the way). Think in all the horses that the United States has killed  along it´s, unfortunately, bloody History; think in the thousands of  horses killed by irresponsible and cruel owners, think in the tens of  thousands of Indian ponies killed by the Army during the XIX century,  think in the millions of wild horses killed by the USDA as well as the  BLM and their wrong and stupid measures during the XX century (specially  in 1929, like horses were the responsible of the economic crush);  measures that still going on today with no reason except the  ‘improvement of the wallet of a bunch of egoist and odious  mustang-murderers’ over the public lands (yes, I said PUBLIC LANDS).  Think that horses are your far cousins. Please help us to save lives.

PLEASE, PROSECUTE DALLAS CROWN INC. In addition, the Texas Attorney  General has ruled that these plants’ activities are illegal, and that  killing a horse is a FELONY. Please, PROSECUTE IT, START PROCEEDINGS  AGAINST THAT FACILITY.  

 In short: You MUST PROSECUTE DALLAS CROWN PACKING INC. because (in  addition of the previously commented):  

 1. Horses are wonderful creatures with feelings and conscience of  theirselves, like humans, so they DO NOT deserve to be killed in any  way, included the slaughtering, just like humans do not slaughter  theirselves. In addition they have been forced to do a lot of things for  humans, so they HAVE won THEIR RIGHT TO LIVE AND TO BE FREE as well as  human´s respect.  

 2. The ‘slaughter methods’ used to murder (torture and  exterminate) these horses are anything BUT painless. The 2000 Report of  the American Veterinary Medical Association Panel on Euthanasia has  ruled that the methods used by murder them are ANYTHING BUT ‘PAINLESS’:  They hit horses with a steel-articulated hydraulic bar (bolt) in their skull (smashing the bones and the brain with a HUGE AND TERRIBLE PAIN,  like a motorbiker without helmet in a high-speed traffic crush,)  repetiously (even 5 times). The terror and pain the horses experience at  this moment is unimaginable. The aim of the bolt is NOT to kill the  horses, but just to immobilize them with the force of the blow; then  they are literally carved up and their throat is cut open when they ARE  STILL ALIVE AND CONSCIOUS, so the blood will drain out until the horse's  heart beats for the last time.  3. Horses are intelligent creatures with conscience of theirselves  so they have feelings like humans. In fact they experience not also  physic pain but PSYCHOLOGIC PAIN AND SUFFERING TOO: they suffer a huge  depression while they are on their fateful way to death as well as they  are waiting in the pens (‘killer pens’ ). In addition, apart from their  intelligence, they have an acute sense of hearing and smelling, well  beyond human development: They could literally hear and smell the danger and death, their violent and cruel death. Now, depression has  turned to terror. What you see is unmistakable. The horses are trembling  violently and urinating on themselves, the smell of death is palpable  and the horses are reacting with PANIC and FEAR. They clearly perceive  they are next in line for horrific pain and death.  

 4. The transportation of these horses is cruel and painful. Horses  are often transported in double deck cattle trailers, which prevent them  from standing upright and causes SEVERE head, back, and neck INJURIES.  Horses are trucked for days with no food, water, rest or medical  attention. This scene is the same as the Jewish prisoners overcrowded  in trains and wagons in their way to the extermination camps during the  ‘Second World War’.  

 5. The majority of horses slaughtered in these plants are NOT old,  sick, or lame, but instead, are YOUNG, HEALTHY American horses,  including PREGNANT MARES AND MARES WITH FOALS AT THEIR SIDE, bought by  killer buyers who attend horse auctions where they compete with families  and horse brokers looking for good, sound horses. In this way, killing,  murdering horses by sending them to the slaughterer´s nightmare because  they are old, sick or lame is also a CRIME: Horses are NOT paper-hankies  that humans can ‘use’ and then throw away like garbage when they are  ‘useless’.

  6. Horses are part of the American Heritage as, for example, the  former President, Mr. Clinton said: “Horses are a vital part of our  Nation´s culture and History. Their strenght and stamina enabled our  forefathers to explore and settle America , and they have become our  faithful companions in work, sport and leisure”…. President Bill  Clinton.  

 7. THE TEXAS ATTORNEY GENERAL HAS RULED that the sale of  horsemeat for human consumption is a CRIMINAL OFFENSE WHEREVER IT TAKES  PLACE.  

 8. THIS POINT IS CRITICAL : H.B. 1324 the bill which was  introduced by Rep Betty Brown (R-Kaufman) IN RESPONSE TO A RECENT   TEXAS ATTORNEY GENERAL OPINION (No. JC-0539) RULING THAT THE TWO HORSE  SLAUGHTER PLANTS IN TEXAS – one in KAUFMAN and one in Ft. Worth – ARE  OPERATING IN VIOLATION OF SECTIONS 149.002 AND 149.003 OF THE  AGRICULTURE CODE WHICH MAKE IT A CRIMINAL OFFENSE TO SELL, POSSESS,  OFFER TO SELL, IMPORT, EXPORT OR TRANSFER HORSEMEAT FOR HUMAN  CONSUMPTION WHEREVER IT TAKES PLACE is DEAD, so the activities of that  facility REMAIN ABSOLUTELY ILLEGAL AND PUNISHABLE, because they are  AGAINST THE LAW, like assassinations or narcotics trafficking.  Therefore, Mr. Walton, we are facing an INTOLERABLE AND OVERWHELMINGLY  HUGE SUBVERSION AND DEGRADATION OF JUSTICE: SELECTIVE ENFORCEMENT. ANYBODY IS BEYOND JUSTICE, NOT EVEN ATTORNEYS NOR FOREIGN OWNED  COMPANIES, and NOT PROSECUTE that plant in order to make ALLOW IT TO  CONTINUE WITH ITS ABSOLUTELY ILLEGAL ACTIVITIES and to profit from it;  from the death, pain and suffering of these lovely and defenseless  creatures called horses; improving wallets (as well as, respectfully,  some Texan politician´s wallet) is not also a FLAGRANT INJUSTICE as well  as a IMMORALITY and a LACK OF ETHIC but an obvious symptom of CORRUPTION  too. Anybody, Mr. Walton, can just change laws or AVOID PROSECUTION in  order to profit from it, and as District Attorney you MUST, you HAVE to  PROSECUTE that plant. Legislature, LAWS, are make to PROTECT WEAKER AND  DEFENSELESS ONES (horses) FROM THE ABUSE OF THE MIGHTIER ones, not to  improve wallets and portfolios. This is the meaning of the word JUSTICE,  the meaning of a ‘FREE’ and ‘DEMOCRATIC’ country; country which example is the United States . If these horrible examples of INJUSTICE, CRUELTY,  CORRUPTION AND IMMORALITY still going on, Texas , as well as the whole   United States will stop of being the example of Freedom and Justice, to  become the country of the ‘everything for the money’, where, the Justice  has been misdirected from the art of protecting weaker´s rights to the craft of portfolio management. And if there are LAWS WHICH PROTECT  HORSES in the law books, these laws MUST BE RESPECTED AND PUT INTO  EFFECT, NOT IGNORED NOR MANIPULATED AT WILL OF CRIMINALS to allow them  to CONTINUE with their CRIMES and ASSASSINATIONS with complete IMPUNITY;  and if a JUDGE, furthermore, if the TEXAS ATTORNEY GENERAL HAS RULED  THAT THESE ACTIVITIES ARE ILLEGAL AND MUST BE STOPPED AND PUNISHED  BECAUSE THEY ARE AGAINST LAW, YOU CANNOT IGNORE THIS LAW TO ALLOW THIS  PLANT TO EVADE THEIR PUNISHMENT AND TO CONTINUE WITH ITS CRIMES. This  is like not prosecute narcotics traffickers despite there are tons of  proofs of their guiltiness because an Attorney “have not intention of  prosecute them”. This excuse, apart from become the Judicial System is a joke, is not only meaningless, stupid and ridiculous, but also abject,  malicious as well as perverse; and such SUBVERSION AND DEGRADATION OF  JUSTICE MUST NOT BE TOLERATED.  

 9. The only two horse slaughter plants in this country are here in   Texas and they are operating ILLEGALLY.  

 10. The most part of the public opinion is AGAINST these horrible  CRIMINAL ACTIVITIES: A scientific poll showed that 70% of those polled  support a ban on horse slaughter. Non-scientific polls show up to 90% in  favor of banning horse slaughter. The Texas State Senators have received  over 1,000,000 calls, faxes, letters and emails asking them to REJECT HB  1324 and to BAN HORSE SLAUGHTER (so this plant´s activities too).  

 11. In other States like California , Indiana or Pennsylvania  killing a horse is a CRIME and that is punished by their PENAL CODE with  PRISON punishments.  

 12. One is owned by a Belgian company, the other by a French  company. ALL ‘profits’ from horse slaughter in Texas go to those foreign  companies.  

 13. All horsemeat produced at these slaughter plants is sent to   France , Belgium , Germany , Italy and Japan .  

 14. Last year these plants slaughtered approximately 43,000  American horses, and their sales of horsemeat to foreigners exceeded  $40,000,000.  

 15. If you do not prosecute Dallas Crown Packing Inc., it will  irremediable and severely damage the image of Texas at all levels,  national as well as international; Texas will become an horrible and  hateful State which permits murderers to kill innocent and defenseless  horses in order to improve foreign wallets (respectfully, I also would  say some Texan politician´s wallets). In addition the Horse Lovers  Community will have no choice but to boycott Texas and it´s economic  activities at all levels: Anyone of us will not invert or spend our  money in Texas industries nor Texan products; neither anyone of us will  vacation there nor we will do or accept any work on behalf of a firm in   Texas . I am absolutely sure that this will cause severe damages to Texan  Economy, not the closing of those two MURDERERS plants and their  CRIMINAL ACTIVITIES.  

 16. Last but not least, let's address the economic aspect of  closing these two slaughter houses. The 6 million horses currently in  the U.S. have a direct impact on the U.S. Gross Domestic Product of  $25.3 billion, or over $4,200 per horse. Slaughter bound horses  represent less than 1 percent of the total number of horses in the U.S.  If these horses are absorbed into the current horse population, it would  mean adding almost a quarter of a billion dollars to the economy each  year. The economic impact of closing the slaughterhouses would be the  temporary loss of 130 minimum wage, high-turnover jobs in two counties  in Texas .  

 17. There are many organizations (for example: Equus Sanctuary,  Equine Advocates Inc., Habitat for Horses Inc., and many other) which  will recover and look after all the horses which, if this plant is  closed, will be safe from this nightmare; and these organizations will  be very pleased to recover, look after, shelter, feed as well as give  medical attention to them if it is necessary; in addition, any horse  deserve to be murdered, killed because somebody discarded him/her like  on a whim. Horses are NOT paper hankies, tissues or toys which humans  can use and then throw away like garbage when they are old or ‘useless’;  so the excuse of what to do with the ‘unwanted’ horses (all horses are  wanted, at least for these organizations and for people like me) is  refuted, because it is FALSE, ABJECT AND MEANINGLESS.  

 18. If these plants are closed there will NOT be an increase of  abused or neglected horses. During the last 5 years have been a  decrease of the number of horses killed, murdered by these plants (from  200,000 to 43,000) and there were NOT any increase or build up of abuse  cases, because these horses has been absorbed into the U. S. horse  population. If the population has absorbed 200,000 horses with no  problem nor increase of abuse cases, it can absorb this 43,000 horses  without any problem. In fact, since California BANNED horse slaughter in  1998 there were NOT any increase or build up of abused or neglected  horses. Also these plants do NOT want abused or skinny horses, they only  buy YOUNG, HEALTHY AND SOUND horses. So this excuse, given by these  plants, is REFUTED because is FALSE, ABJECT AND MEANINGLESS.  

 19. The BLM´s and USDA´s adoption program FAILED to protect wild  horses, because wild horses captured illegally (the BLM and the USDA are  in violation of ‘WILD FREE-ROAMING HORSE AND BURRO ACT’ - PL 92-195-)  are sold even by the own BLM´s and USDA´s staff (who serve their own  family interest) to the slaughterhouses in a FLAGRANT case of CORRUPTION  and such DEGRADATION AS WELL AS MISDIRECTION OF JUSTICE MUST NOT BE TOLERATED.  

 20. Horse slaughter DOES PROMOTE horse ‘thieving’. Point case:  Since California BANNED horse slaughter in 1998 there was a 50%  DECREASING on horse ‘thieving’. This is because the most part of the  ‘stolen’ horses are sold to the slaughterhouses WITH THE PLANTS´  KNOWLEDGE AND CONSENT.  

 21. The most part of the owners who sell their horses in auctions are UNAWARE that their horses could end at the slaughterhouse; even these  owners are DECEIVED by the killer buyers, who told to them that the  horses will go to good homes where they will be loved and respected.  

 22. The whole of the Horse Welfare Groups as well as the Equestrian  Associations like Wild Horse and Burro Freedom Alliance, The American  Horse Defense Fund, New Jersey Racing Commission, the New York Racing  Association, the National Thoroughbred Racing Association, and the  Breeders' Cup, Thoroughbred Retirement Foundation, etc…. are AGAINST the  CRIMINAL ACTIVITIES of that plants.  

 In conclusion: Killing a horse is a CRIME and must be punished by law, like in California or like the Texas Agriculture Code; law that you  are ignoring, so you are committing SELECTIVE PROSECUTION. In addition  not only are the horses who live in Texas being murdered by these plants and their cruel and hateful killer buyers and irresponsible owners, but  horses from all around the country are being murdered too; because these  plants, in violation of some States PENAL CODE, illegally ‘buy’ horses from equally guilty killer buyers, and then send them to Texas in order to murder them there. This is UNBEARABLE, because these plants not only are violating Texas Law but other States Law too, and Texas , apart from  putting an end to these CRIMINAL ACTIVITIES, must RESPECT other States  Law and their citizenship´s will to protect horses. Also, Texas´  reputation would be severe and irreparably damaged as a result of  this SEVERE SUBVERSION AND DEGRADATION OF JUSTICE. You can help to  prevent and to put an end to these cruel and horrible criminal  activities by PROSECUTING THAT FACILITY. You can argue that Texas is an  honest and ‘humane’ State, and as such, will not allow nor take part in  these horrible CRIMINAL ACTIVITIES. If not, I and many other Horse  Lovers will have no choice but to boycott Texas : If you do not prosecute  that plant, neither I nor the whole of Horse Lover Community will buy   Texas -made products nor will invest our money in Texan industry; we will  invest our money in ‘horse-caring’ States like California and their  ‘horse-harmless’ state-of-the-art technological industries such as  telecommunications or computer industries, instead Texan classical  chemical and heavy industries. We will not vacation on Texas , nor will  we do any work on behalf of a firm in Texas . That´s how much that  plant´s prosecution means to me and to many others Horse Lovers like me.  The Texas Senate received over 1,000,000 calls, emails, and faxes from  all over the world concerning the horse slaughter bill in order to stop  it. The Senate did not pass it. Therefore, horse slaughter in the state of Texas IS ILLEGAL. Will you listen to their voice? Will you listen  to our voice? The activities of that plant are pork-barreling in the  worst sort of way. It is time to do justice to horses.
