December 4, 2003  Defendant Curry's brief
in reply to plaintiffs' response to motion for summary judgment
 
I understand that the Court's ruling could come at any time or might not come for months.
 
For those of you who are new to all this legal stuff....Beltex and Dallas Crown (the two Texas slaughter plants) filed suit in federal court on 9/26/2002 to stop the Tarrant County and Kaufman County Districts of Attorney from prosecuting them for violation of Texas Agriculture Code Section 149.  The newly elected Kaufman County DA (Ed Walton) withdrew from the case in early 2003, but Tarrant County DA Tim Curry (via Assistant DA Ann Diamond) is actively defending the lawsuit. 
 
Beltex is in Fort Worth, Texas, which is in Tarrant County.  Dallas Crown is in Kaufman, Texas, which is in Kaufman County.
 
This lawsuit is the reason the two Texas slaughter plants are still in operation.
